Terms of Use

These Terms of Use (“Terms”) govern your use of escapesameness.com (the “Site”) and any purchase you make on it. The Site and the Escape Sameness collection are operated by Pill Creative Studio LLC (“Pill Creative Studio LLC”, “we”, “us” or “our”). By using the Site or buying a brand, you agree to these Terms. If you don’t agree, please don’t use the Site.

1. Who we are

Escape Sameness is a trade name of Pill Creative Studio LLC. All sales on the Site are made by Pill Creative Studio LLC, and Pill Creative Studio LLC is the name that will appear on your card statement and receipt.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to buy from us. If you buy on behalf of a company, you confirm you are authorized to bind that company to these Terms.

3. Our brands

Each brand on the Site is an original identity — a name, a matching domain, a logo system, color and typography specifications, brand guidelines and source files (a “Brand”). The exact contents of each Brand are listed on its page. Images on the Site are presentations of the Brand; the files you receive are the deliverables listed on the Brand page.

Every Brand is sold once, to one buyer. Once a Brand is purchased it is marked SOLD and is not offered again.

4. Orders, pricing and payment

  • Prices are shown in US dollars. Payment is processed securely by Stripe; we never see or store your full card details.
  • Your order is accepted when payment is completed. You will receive a confirmation email with your download link.
  • If two customers complete checkout for the same Brand at nearly the same moment, the first completed payment receives the Brand and any later payment is refunded in full.
  • If a Brand is listed with an obvious pricing or listing error, we may cancel the order and refund you in full.
  • You are responsible for any taxes, duties or bank fees that apply to your purchase in your country.

5. All sales are final

Because every Brand is exclusive, sold only once and delivered digitally the moment you check out, all sales are final. We do not offer refunds, returns or exchanges. The only exceptions are described in our Refund Policy. By completing checkout, you request immediate delivery of the digital files and acknowledge that you lose any right to cancel or withdraw from the purchase once delivery has begun, to the extent permitted by law.

6. Delivery and domain transfer

After payment you receive a private download link, valid for 30 days. The domain is transferred separately: you send us your registrar details using the form on the order confirmation page, and we move the domain to your account, usually within 1–2 business days. Registrar rules (for example, a 60-day lock after a domain is registered or transferred) can affect timing. After the transfer, renewal fees for the domain are your responsibility.

7. Ownership and use of the Brand

Your rights in a purchased Brand are set out in the Purchase Agreement, which forms part of these Terms. Until a Brand is purchased, all names, logos, artwork and other content shown on the Site belong to Pill Creative Studio LLC. You may not copy, adapt, register or use any unsold Brand, or any element of it, without buying it.

8. Trademarks — please read

We screen brand names in the USPTO database approximately every three months and logo marks in the WIPO Global Brand Database. This screening is periodic, not continuous, and it is not legal advice, a trademark clearance opinion or a guarantee that a Brand is available for use or registration in any country or industry. Before you launch or register a Brand, you are responsible for conducting your own trademark clearance, ideally with a trademark attorney.

9. Typefaces

Typefaces specified in a Brand belong to their designers or foundries. Most are free Google Fonts; any license a typeface requires is your responsibility.

10. Custom work

Custom brands, websites and other services requested through “Start a project” are quoted separately and governed by the proposal or agreement we send you, not by these Terms’ sale provisions.

11. Using the Site

You agree not to misuse the Site — for example, by interfering with its operation, attempting to access it without authorization, scraping its content, or submitting false, unlawful or spam content through our forms. The Site’s design, text and images are protected by copyright and other laws.

12. Third-party services

We rely on third-party services such as Stripe (payments), GoDaddy and other registrars (domains) and our hosting and email providers. Their own terms apply to your use of them, and we are not responsible for their services.

13. Disclaimers

Except as expressly stated in these Terms or the Purchase Agreement, the Site and all Brands are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that a Brand will achieve any particular business result.

14. Limitation of liability

To the maximum extent permitted by law, Pill Creative Studio LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Site or a Brand is limited to the amount you paid us for that Brand.

15. Indemnity

You agree to indemnify and hold Pill Creative Studio LLC harmless from claims arising from your use of a Brand after purchase, including any use made without first completing your own trademark clearance, or from your breach of these Terms.

16. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction. Nothing in these Terms limits rights you have under mandatory consumer protection laws where you live.

17. Changes

We may update these Terms from time to time. The version in effect when you made your purchase applies to that purchase. The “Last updated” date above shows when these Terms last changed.
