Purchase Agreement

This Purchase Agreement (“Agreement”) is between Pill Creative Studio LLC (“Pill Creative Studio LLC”, “we”, “us”), which operates Escape Sameness, and the person or company completing the purchase (“you”, the “Buyer”). It applies to every brand bought on escapesameness.com and becomes binding when your payment is completed. Your Stripe receipt and order confirmation email identify the brand, the date and the price paid. Please keep them, together with this Agreement, with your records.

1. What you are buying

The brand shown on the brand page you purchased from (the “Brand”), consisting of: the brand name; the listed domain name; the logo system (primary, secondary, symbol and wordmark versions in color, black and white, as PNG and SVG files, plus an animated logo file in JSON format); color specifications (HEX, RGB and CMYK) and typography, with links to the typefaces; brand guidelines; and source files (vector SVG files of the logo and the brand guidelines as an editable Figma file) (together, the “Deliverables”).

2. Delivery

The Deliverables are delivered digitally through a private download link sent by email immediately after payment. The link is valid for 30 days; please download and keep a copy. We will transfer the domain to the registrar account you specify, as described in section 6.

3. Transfer of rights

Upon receipt of full payment, Pill Creative Studio LLC assigns to you all of its right, title and interest, including copyright, in the original artwork created for the Brand — the logo system and the brand-specific design work in the Deliverables. You may use, modify, reproduce and register the Brand for any lawful purpose, and you may sell or transfer it.

Third-party materials included or specified in the Brand — such as typefaces, stock imagery or icons — remain the property of their owners and are licensed under their own terms. Most typefaces we specify are free Google Fonts; you are responsible for any license a typeface requires.

4. Exclusivity

The Brand is sold once. After your purchase we remove it from sale and will not sell, license or give the same Brand to anyone else. We may keep archival copies of the files and may continue to show the Brand, marked as SOLD, on this website and in the Pill Creative Studio LLC portfolio. If you’d prefer it not to be shown, email us and we’ll remove it from public display.

5. Trademarks — no warranty of availability

We screen brand names in the USPTO database approximately every three months and logo marks in the WIPO Global Brand Database for conceptual and shape similarity. This screening is periodic, not continuous, and is not legal advice or a trademark clearance opinion. We do not warrant that the Brand is available for use or trademark registration, or free of conflict with others’ rights, in any jurisdiction, class or industry. You are solely responsible for conducting your own trademark clearance — ideally with a trademark attorney — before using or registering the Brand. We have not registered the Brand as a trademark; registering it, if you wish, is your responsibility.

6. Domain transfer

We will move the domain to your account after you submit your registrar details. Transfers within GoDaddy are usually completed within 1–2 business days; for other registrars we provide an authorization code. Registrar rules, such as a 60-day lock after registration or transfer, may affect timing. Once the domain is in your account, renewals, DNS and hosting are your responsibility.

7. Final sale — no refunds

All sales are final. The Brand is sold as is, and no refunds, returns or exchanges are offered, except as stated in our Refund Policy (the Brand had already been sold, we are unable to deliver, or a refund is required by law). By completing checkout, you request immediate delivery of the digital files and acknowledge that you lose any right of withdrawal once delivery has begun, to the extent permitted by law. If a payment is reversed or charged back, the rights assigned under section 3 and the domain revert to Pill Creative Studio LLC.

8. Your responsibilities

You are responsible for how you use the Brand, including its compliance with laws, regulations and third-party rights in the markets and industries where you use it.

9. Warranties and limitation of liability

We warrant that the original artwork in the Brand was created by our designers and that, to our knowledge, it does not copy any third party’s work. Apart from that, the Brand is provided “as is”, without other warranties, express or implied. To the maximum extent permitted by law, Pill Creative Studio LLC is not liable for any indirect, incidental, special or consequential damages, or lost profits, and our total liability relating to the Brand is limited to the amount you paid for it.

10. General

This Agreement, together with the Terms of Use and Refund Policy, is the entire agreement between us about the Brand. It is governed by the laws of the State of California, and disputes will be resolved in the courts located in Los Angeles County, California. If any part is found unenforceable, the rest remains in effect. You may assign this Agreement to a successor who acquires the Brand from you.
